How Does Bankruptcy Work?

The process of bankruptcy is designed to protect individuals or businesses that cannot repay their debts. Your debt will be eliminated or restructured in a manageable way. The process is overseen by the federal bankruptcy courts, each of which is managed by a trustee. The most common type of bankruptcy for individuals is Chapter 7 also known as liquidation.

Learn How Bankruptcy Can Protect You

Chapter 7 bankruptcy eliminates your debt, once you’ve filed for bankruptcy, an “automatic stay” goes into place, which is meant to stop all creditor actions.

Some of these actions that you are protected from include:

  • Collection calls
  • Eviction from a rental property
  • Home foreclosure
  • Utility disconnection
  • Wage garnishments
There are protections provided by the automatic stay, but the debt related to your utility bills and housing will still need to be paid. The automatic stay means that no one can take action against you, but it does not cancel all of your related debt.

What Types of Debt Are Affected by Bankruptcy?

  • Credit card debt and medical debt CAN be discharged through bankruptcy.
  • Student loan debt and IRS debt CANNOT be discharged through bankruptcy.
